Privacy Policy

Effective Date: March 2011

Welcome to the Proskauer Rose LLP (“Proskauer,” “we,” or “us”) Alumni Network Web site (“Alumni Site” or “Site”), where you can share information about yourself and learn about your Proskauer colleagues, both past and present. Your privacy is important to Proskauer. For this reason, we created this Privacy Policy (the “Policy”) to tell you about the types of personal information that Proskauer may collect about you on, or for use on, this Site, the purposes for which we use the information, the options available to you with respect to such information, and the circumstances in which it may be provided to third parties.

1. Policy Changes
Proskauer reserves the right to change or update this Policy at any time, and will notify users by posting such changed or updated Policy on this page. Any changes or updates will be effective immediately upon posting to the Alumni Site. Under certain circumstances we may also elect to notify you of changes or updates to our Policy, or to request your consent to them, by additional means, such as by posting a notice on the front page of this Site or by sending you an e-mail.

2. The Information Collected and Maintained on the Alumni Site
Personal Information: The personal information collected and maintained on the Alumni Site consists primarily of contact data such as addresses and phone numbers, information as to your current employment and professional qualifications, basic details of your tenure with Proskauer, and descriptive data such as gender and ethnicity. Most of this information will be supplied directly by you. However, in order to reduce the amount of data that you must input, Proskauer may separately populate the Alumni Site with certain details concerning your educational background (i.e., college, law school, year of graduation) and your tenure with the Firm (e.g., office location, department, practice area, start and end dates, position at departure). The Alumni Site may also display, or provide links to, articles or news stories from publicly available sources in which you are identified and which we believe would be of interest to other alumni.

Non-personal Information: In addition to the personal information mentioned above, we collect certain non-personal information about your visit to the Alumni Site whenever you access the Alumni Site. When you visit the Alumni Site, we collect your browser type and IP address. Our servers may also record clickstream data, including: the referring page that linked you to the Alumni Site (e.g., another Web site or a search engine); the pages you visit on the Alumni Site; the Web site you visit after the Alumni Site; other information about the type of Web browser, computer, platform, related software and settings you are using; any search terms you have entered on the Alumni Site or a referral site; and other Web usage activity and data logged by our Web servers.

We may also store certain information using cookies and local shared objects (small pieces of data stored on your computer). Tracking technologies track where you travel and what you look at on the Alumni Site, and confirm when you have logged in to the Alumni Site. Tracking technologies may enable us to relate your use of the Alumni Site to other information about you, including Personal Information. Most Web browsers can be set to inform you when a cookie has been sent to you and provide you with the opportunity to refuse that cookie. Additionally, many flash players can be set to many local shared objects. However, refusing tracking technologies may in some cases preclude you from using, or negatively impact the display or function of, the Alumni Site or certain areas or features of the Alumni Site. We also may use “clear GIFs” (aka “Web beacons” or “pixel tags”) or similar technologies in the Alumni Site or in our communications with you (such as in our e-mails), which help us to verify an individual’s viewing or receipt of a Web page or message, and may enable us to relate such viewing or receipt to other information, including Personal Information.

3. How This Information Is Used
Proskauer uses your information to provide services to you, process and respond to your requests, develop new features and offerings, improve the Alumni Site and protect our rights and property as well as that of third parties. We may also use your information to maintain our internal record keeping, to show you a history of your activity, to provide you with statistics about your use of the Alumni Site or to enhance your user experience. We may analyze user behavior as a measure of interest in, and use of, the Alumni Site or services. We may match information collected from you through different means or at different times, including both Personal Information and Non-Personal Information, and use such information along with supplemental information obtained from other sources. The services we provide through the Alumni Site may include: contacting you to provide invitations to Proskauer sponsored events, notifying you of career opportunities at Proskauer, or providing you with information or materials concerning your benefits as a former Proskauer lawyer. We may also use this information to contact you by post, telephone, electronic mail, facsimile, etc., to apprise you of news regarding Proskauer or other Proskauer alumni, legal news and developments, or services offered by Proskauer that may be of interest to you individually or to the company or organization with which you are currently affiliated. By providing your personal information on the Alumni Site, you consent to its use as described above.

4. Third Party Access to Your Personal Data
Your profile information is published to other users of the Site. Unless we obtain your consent to do so, we will not disclose your personal information to third parties other than as reasonably necessary to provide the services for which the Alumni Site is intended or as may be required or permitted by this Privacy Policy, applicable laws and regulations, or any legal process served upon us. Other non-affiliated companies providing services to Proskauer may have access to the information incidental to the uses described above. Such companies are required to maintain the confidentiality of the information and to use it only in the course of providing such services and only for the purposes that Proskauer dictates.

5. Your Control over Your Information
The Alumni Site provides various privacy settings and tools that allow you to restrict or limit access to your personal information by other Site users. Please note, however, that Proskauer will have access to all such information, regardless of whether other users are so restricted. Moreover, even if you do not register for the Proskauer Alumni Network Site or provide personal information to us, or if you limit the personal information accessible by other Site users, there will still be a profile about you on the Alumni Site that displays your name and the last Proskauer office where you worked. This profile will be accessible by other Site users. Except for the profile information described above, you can access, update, correct, or remove your personal information from the Alumni Site at any time you wish by accessing your profile on the Site. To help protect the privacy and security of our users’ information, we may take reasonable steps to verify your identity before granting you access or enabling you to make corrections to your profile.

6. Securing Personal Data
While Proskauer endeavors to protect the security and integrity of the information provided to us, due to the inherent nature of the Internet as an open global communications vehicle, we cannot guarantee that information, during transmission through the Internet or while stored on our system or otherwise in our care, will be safe from intrusion by others, such as hackers.

7. Links to Other Web Sites
This Web site may provide links, banners, widgets or advertisements that lead to other Web sites sponsored and maintained by third parties. Proskauer is providing such links solely as a convenience to you. When you click on these types of third-party content, the privacy policies of the Web sites to which you are linked will govern the collection and use of your information. Proskauer does not have access to or control over any technologies or practices that may be used on linked to sites, and we are not responsible for the privacy practices of them. We encourage you to read the privacy statements of each and every Web site visited after leaving the Alumni Site to learn about how your information is treated.
